1. Overview

This website is operated by JCS Industries LLC, doing business as Staypoollizer. Throughout these Terms of Service, the terms “Staypoollizer,” “we,” “us,” and “our” refer to JCS Industries LLC.

These Terms of Service govern your access to and use of our website, online store, products, services, instructional materials, customer support, and related features.

By visiting our website, placing an order, submitting information, or otherwise using our services, you agree to these Terms of Service and all policies referenced within them, including our Shipping Policy, Return Policy, Privacy Policy, and applicable written product warranty.

Please do not use the website or place an order if you do not agree to these terms.

2. Eligibility

You must be at least the age of majority in your state, province, or country of residence to place an order.

By using this website, you represent that you have the legal authority to enter into an agreement with us. You may not use our website or products for any unlawful or unauthorized purpose.

3. Changes to These Terms

We may update these Terms of Service from time to time.

The current version will be posted on this page with the date of the latest revision. Your continued use of the website after revised terms are posted constitutes acceptance of the revised terms.

Changes will not retroactively reduce rights that already apply to a completed purchase unless permitted by law.

4. Website Information

We make reasonable efforts to keep website information accurate and current. However, product descriptions, photographs, measurements, availability, specifications, pricing, instructional content, and other information may occasionally contain errors or require updating.

We may correct errors, update information, or cancel an affected order when necessary. If an order is canceled after payment, the applicable amount will be refunded to the original payment method.

Information provided on this website is intended for general product selection, installation, operation, and support purposes. It is not a substitute for professional plumbing, pool service, structural, electrical, safety, or legal advice.

5. Product Images, Designs, and Specifications

We make reasonable efforts to display our products accurately. Actual appearance or color may vary depending on device settings, lighting, manufacturing tolerances, and product updates.

Product packaging, components, fittings, labels, or minor design details may be updated without notice when those changes do not materially reduce the product’s intended function.

Customers are responsible for reviewing product dimensions, connection type, measurement range, installation requirements, and compatibility before ordering.

6. Product Selection and Measurements

Staypoollizer products are offered in different models, connection types, and measurement ranges.

The customer is responsible for:

  • Measuring the intended installation location accurately

  • Selecting the correct product model

  • Selecting the correct measurement range

  • Confirming compatibility with the pool, deck, top rail, hose, plumbing, and installation area

  • Reviewing the applicable setup instructions before installation

Guidance provided by customer support is based on the measurements, photographs, and information supplied by the customer. We are not responsible for an incorrect recommendation caused by incomplete, inaccurate, or misleading information provided to us.

7. Orders

Submitting an order is an offer to purchase the selected products.

We reserve the right to accept, decline, limit, or cancel an order for legitimate reasons, including:

  • Product unavailability

  • Pricing or listing errors

  • Suspected fraud or unauthorized activity

  • Payment problems

  • Shipping restrictions

  • Unusually large quantities

  • Suspected resale, misuse, or policy abuse

  • An incomplete, inaccurate, or undeliverable address

An order confirmation does not necessarily mean that an order has been accepted or shipped.

If we cancel an order after payment has been processed, we will issue a refund to the original payment method.

8. Pricing, Payment, and Taxes

Prices are shown in the currency displayed on the website and may change without notice.

The price charged will normally be the price displayed at checkout when the order is submitted, subject to correction of obvious errors.

Customers agree to provide current, complete, and accurate billing, payment, shipping, and contact information.

Applicable sales tax, shipping charges, duties, or other required fees may be added at checkout.

International customers are responsible for customs duties, import taxes, brokerage fees, and destination-country charges unless expressly stated otherwise.

9. Discounts and Promotions

Discounts, promotional codes, free-shipping offers, and other promotions may be subject to separate conditions.

Unless otherwise stated:

  • Discounts cannot be combined

  • Promotions have no cash value

  • Promotions may be limited by product, location, order value, customer, or date

  • Promotions may be changed or ended before an order is placed

  • Discounts cannot normally be applied retroactively to completed orders

We may cancel an order involving unauthorized, altered, duplicated, improperly obtained, or fraudulently used promotional offers.

10. Shipping and Delivery

Shipping, order processing, tracking, delivery estimates, address corrections, expedited services, and missing-package procedures are governed by our published Shipping Policy.

Delivery dates are estimates unless expressly stated as guaranteed.

Carrier delays, severe weather, holidays, customs processing, incorrect addresses, remote destinations, and events outside our reasonable control may affect delivery.

The customer is responsible for providing a secure and accessible delivery location.

11. Returns and Refunds

Returns, refunds, eligibility periods, return authorization, product-condition requirements, restocking considerations, and return-shipping responsibility are governed by our published Return Policy.

Refunds are issued to the original payment method unless another method is required by law or agreed upon.

Original shipping charges, expedited-shipping charges, customs charges, and return-shipping costs may be nonrefundable except where required by law or expressly stated in our policies.

Products that have been modified, damaged, improperly installed, abused, substituted, or returned with missing components may not qualify for a full refund.

12. Product Warranty

Any product warranty is governed exclusively by the written warranty supplied with the product or published on our website.

Warranty evaluation may require:

  • Proof of purchase

  • Order information

  • Product identification

  • Photographs or video

  • Installation measurements

  • Troubleshooting information

  • Return or inspection of the product

  • Confirmation that the product was installed, maintained, and used as directed

Damage or failure caused by improper installation, misuse, alteration, freezing, impact, corrosion, incompatible fittings, damaged hoses, neglected maintenance, environmental exposure, excessive force, or use outside published specifications may not be covered.

No website statement, customer-service communication, or informal advice expands the written warranty unless confirmed in writing by an authorized representative of JCS Industries LLC.

13. Installation and Product Use

Staypoollizer products must be installed, adjusted, maintained, winterized, and used according to the applicable instructions and published specifications.

The customer is responsible for:

  • Confirming that the selected model fits the intended pool and installation location

  • Selecting the correct measurement range

  • Properly assembling and securing the product

  • Using suitable hoses, gaskets, fittings, and connections

  • Avoiding damaged, corroded, incompatible, or improperly threaded fittings

  • Inspecting all connections for leaks

  • Confirming that the float and shutoff mechanism move freely

  • Monitoring the installation after setup

  • Protecting the product, hose, and plumbing from freezing

  • Complying with applicable plumbing codes, water restrictions, and backflow-prevention requirements

  • Shutting off the water supply and discontinuing use when damage, leaking, unusual movement, vibration, or improper operation is observed

Before leaving the connected water supply unattended, the customer should observe the installation through multiple filling and shutoff cycles and confirm that it operates without leaking, excessive movement, vibration, unusual noise, or water hammer.

Staypoollizer helps maintain a selected pool-water level. It does not eliminate the need to inspect the pool, water supply, hose, fittings, plumbing, equipment, or surrounding property.

Do not alter the product or use it for an application for which it was not designed.

14. Water Supply and Property Conditions

The customer is responsible for the condition, suitability, maintenance, and operation of the property’s water supply, plumbing, hose bib, valves, pipes, hoses, fittings, pool structure, deck, wall, top rail, pool equipment, and installation area.

Staypoollizer is not responsible for damage caused by conditions outside the product itself, including:

  • A failed, leaking, burst, damaged, or improperly connected hose

  • Loose, worn, damaged, corroded, incompatible, or improperly threaded fittings

  • Missing or damaged hose washers or gaskets

  • Frozen water, hoses, pipes, fittings, valves, or plumbing

  • Defective or deteriorated household plumbing

  • Excessive movement of the mounting surface

  • Water-supply interruption

  • Pressure outside the product’s published specifications

  • Improper installation or adjustment

  • Failure to inspect or maintain the installation

  • Pool, deck, wall, rail, plumbing, pump, skimmer, or equipment defects

The customer must shut off the water supply and discontinue use whenever the product, hose, fitting, connection, plumbing system, pool, or installation area appears damaged, unstable, or unsafe.

15. Water Hammer, Pressure Surges, and Plumbing Protection

Operation of a Staypoollizer involves the automatic starting and stopping of water flow. Depending on the property’s water pressure, pipe arrangement, pipe support, valve characteristics, hose, plumbing condition, and other installation factors, operation may produce water hammer, pressure surges, banging, vibration, pipe movement, or unusual plumbing noise.

Before installation, the customer is responsible for confirming that the water-supply system is properly installed, maintained, supported, and suitable for connection to an automatically operating water-control device.

If banging, vibration, pipe movement, leaking, unusual noise, or another indication of water hammer occurs, the customer must:

  1. Immediately shut off the connected water supply.

  2. Discontinue use of the Staypoollizer.

  3. Inspect the hose and all visible connections.

  4. Have the plumbing system evaluated by a qualified plumber before resuming operation.

The customer is responsible for installing any water-hammer arrestor, pressure regulator, expansion device, backflow-prevention device, shutoff valve, leak-detection device, or other plumbing protection required by the property’s conditions, connected plumbing components, manufacturer instructions, or applicable plumbing requirements.

To the maximum extent permitted by law, JCS Industries LLC is not responsible for internal plumbing leaks, pipe failures, fitting failures, flooding, water intrusion, mold, structural damage, damage to a home or other dwelling, or damage to personal property to the extent caused by:

  • Water hammer or pressure surges originating within the property’s plumbing system

  • Excessive, fluctuating, or improperly regulated water pressure

  • Missing, defective, improperly sized, or improperly installed plumbing-protection devices

  • Loose, unsupported, corroded, deteriorated, frozen, worn, damaged, or defective pipes, valves, hoses, fittings, or connections

  • Failure to stop using the product after banging, vibration, leaking, pipe movement, or another abnormal condition becomes apparent

  • Installation that does not comply with the product instructions, accepted plumbing practices, manufacturer requirements, or applicable codes

  • Failure to inspect, maintain, repair, or protect the property’s plumbing system

Nothing in this section excludes or limits responsibility that cannot lawfully be excluded, including responsibility arising from a proven defect in the Staypoollizer product itself.

16. Leaks, Flooding, and Unattended Operation

Any product connected to a pressurized water supply presents a potential risk of leaking or water damage if a hose, fitting, valve, pipe, connection, plumbing component, or installation surface fails.

The customer is responsible for determining whether additional safeguards are appropriate for the property, including:

  • A readily accessible water shutoff valve

  • A properly installed water-hammer arrestor

  • A pressure regulator

  • A leak-detection or automatic shutoff device

  • Periodic inspection by the property owner, pool professional, caretaker, or other responsible person

Staypoollizer is not a whole-property flood-prevention or plumbing-monitoring system and should not be relied upon as a substitute for proper plumbing maintenance, leak detection, property inspection, or insurance.

17. Water Pressure

Staypoollizer products must only be operated within the published pressure specifications for the applicable model.

The customer is responsible for confirming the property’s water pressure and for addressing excessive, unstable, or unusual pressure conditions.

Published operating-pressure capability does not guarantee that the property’s pipes, valves, hose bib, hose, fittings, backflow devices, or other plumbing components are rated or suitable for the same pressure.

A pressure regulator or other protective device may still be required for the property’s plumbing system even when the Staypoollizer product itself is rated for the available pressure.

18. Freezing and Weather Conditions

The customer is responsible for disconnecting, draining, removing, or protecting the product and connected plumbing when freezing temperatures are possible.

Damage caused by freezing water, ice expansion, frozen hoses, frozen fittings, frozen valves, or failure to winterize is not covered unless expressly stated in the written warranty.

The product should not be left out of the water in prolonged direct sunlight or extreme heat when doing so may cause excessive heating, deformation, deterioration, or damage.

19. Technical and Customer Support

We may provide instructions, troubleshooting assistance, measurement guidance, product-selection assistance, and customer support.

Support recommendations are based on the information supplied by the customer. Customers are responsible for providing accurate descriptions, photographs, measurements, order details, pressure information, and installation information.

Remote assistance cannot identify every condition that may exist at an installation site.

Customers should consult an appropriate local professional when a condition involves:

  • Plumbing codes

  • Backflow-prevention requirements

  • Structural concerns

  • Property damage

  • Internal plumbing leaks

  • Water hammer

  • Unusual pressure

  • Electrical equipment

  • Pool-system damage

  • Safety hazards

20. Reviews and User Content

When you submit a review, photograph, video, testimonial, comment, question, or other content, you represent that:

  • You have the right to submit it

  • It is based on your genuine experience

  • It is accurate to the best of your knowledge

  • It does not violate another person’s privacy or intellectual-property rights

  • It does not contain unlawful, threatening, defamatory, abusive, deceptive, or fraudulent material

You grant JCS Industries LLC a nonexclusive, worldwide, royalty-free license to use, reproduce, resize, edit for formatting, publish, display, and distribute submitted content for customer service, product improvement, education, advertising, and marketing.

We will not knowingly alter a review in a manner that changes the reviewer’s material opinion.

We may remove content that violates these terms, applicable law, or platform rules.

21. Intellectual Property

The Staypoollizer name, product designs, photographs, videos, written content, instructions, diagrams, graphics, logos, trademarks, website layout, and other materials are owned by or licensed to JCS Industries LLC.

You may access these materials for personal, noncommercial shopping, installation, and product-support purposes.

You may not reproduce, modify, distribute, sell, publish, scrape, reverse engineer, copy, or commercially exploit our content or product designs without written permission.

22. Prohibited Uses

You may not use the website or services to:

  • Violate any law or regulation

  • Infringe intellectual-property rights

  • Submit false or misleading information

  • Transmit malicious code

  • Attempt unauthorized access

  • Interfere with website security or operation

  • Collect information through unauthorized automated methods

  • Impersonate another person or business

  • Commit payment fraud, return fraud, warranty fraud, or promotional abuse

We do not guarantee that the website will always be uninterrupted, error-free, secure, or available.

We may modify, suspend, restrict, or discontinue any part of the website when reasonably necessary for maintenance, security, legal compliance, product updates, or business operations.

25. Disclaimer of Warranties

Except for any written product warranty expressly provided by JCS Industries LLC, and to the maximum extent permitted by law, the website, website content, and related services are provided on an “as available” and “as is” basis.

We do not warrant that:

  • The website will always be available, secure, or error-free

  • Every product will be suitable for every pool, property, plumbing system, or installation

  • Website information will never contain an error

  • Customer expectations not stated in the product description or written warranty will be met

  • Third-party carriers, payment services, applications, or websites will operate without interruption

  • Installation of the product will correct or protect against preexisting plumbing, pool, hose, fitting, structural, or property defects

Nothing in these terms excludes or limits warranties, remedies, or consumer rights that cannot lawfully be excluded.

26. Limitation of Liability

To the maximum extent permitted by law, JCS Industries LLC and its owners, employees, representatives, contractors, suppliers, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from:

  • Use of or inability to use the website

  • Purchase, installation, or use of a product

  • Loss of water

  • Loss of pool use

  • Lost profits or business interruption

  • Lost data

  • Water hammer

  • Internal plumbing leaks

  • Pipe, hose, valve, or fitting failure

  • Flooding, water intrusion, mold, or property damage caused by conditions outside the product itself

  • Failure to follow installation, maintenance, pressure, freezing, inspection, or safety instructions

  • Third-party carrier, payment-provider, application, or service failures

To the maximum extent permitted by law, our total liability relating to a product or order will not exceed the amount paid for the specific product giving rise to the claim.

These limitations do not apply to liability that cannot lawfully be limited or excluded.

27. Indemnification

To the extent permitted by law, you agree to indemnify and hold JCS Industries LLC harmless from third-party claims, losses, damages, and reasonable expenses arising from:

  • Your unlawful use of the website

  • Your material violation of these terms

  • Your infringement of another party’s rights

  • Your intentional misuse or unauthorized alteration of a product

  • Installation or use that materially conflicts with the published instructions

The remaining provisions will continue in effect.

29. No Waiver

Our failure to enforce a provision does not waive our right to enforce it later.

A waiver is effective only when it is in writing and authorized by JCS Industries LLC.

30. Entire Agreement

These Terms of Service and the policies referenced within them constitute the agreement between you and JCS Industries LLC concerning use of the website and purchases through the website.

They replace prior website terms addressing the same subject matter but do not replace an applicable written product warranty, confirmed order term, or right provided by law.

31. Governing Law

These Terms of Service are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Any dispute that cannot be resolved informally may be brought before a court of competent jurisdiction, subject to applicable consumer-protection and jurisdictional laws.

32. Electronic Communications

By contacting us electronically, placing an order, or using the website, you agree that we may provide order confirmations, shipping updates, policy notices, support communications, and other transaction-related communications electronically.

Marketing communications are governed by the choices and consent options presented when you subscribe.
